1. Use of our website
By using this website you signify your consent to the handling of your personal information and declare that all personal information you provide is true and correct.
By using this website and/or placing any through it, you agree to the following:
I. To only use this website for legal research and/or purchases/orders. II. To not make false or fraudulent orders. If we reasonably believe that an order of this type has been placed, we shall be entitled to cancel it and will alert the relevant authorities. III. To provide us with your email address, postal address and/or other contact details that are true and correct.
By making a purchase on this website, you warrent that you are older than 18 and that you are legally able to enter into binding contracts.
2. Formation of the Contract
The information set forth in these Conditions as well as all the details on the website do not constitute an offer of sale, but an invitation to treat. No contract shall exist between us and you the client relative to any product until such time as the client’s order has been expressly accectped by us.
If your offer is not accepted and there has been a debit on your account, you will be refunded in full.
All orders are subject to acceptence by us and we will confirm this acceptence by sending you an email confirming the items are being sent (the Shipping Confirmation). The contract for the purchase of an item between us (the Contract) will only be formed once we send you the Shipping Order.
To complete your order successfully, certain personal information will be required, such as your email address, name, postal address, contact phone number, etc. You must fill out all mandatory fields to finalize your order. By making a purchase online, you signify your acceptance of the general conditions of sale, of our prices, and of the description of the items involved in the transaction. The general conditions of sale will be the only ones applicable between the two parties. If the product is unavailable, www.passeatta.com will refund the client the amount paid within thirty days of the produc’s unavailability being ascertained.
4. Service Availablity
The articles on sale on our website are available to be delivered only in Portugal and other European countries.
5. Price Policy
All prices include VAT (Portuguese IVA). All prices and specifications are subject to change without notice.
The price for each item is that which is stipulated and displayed on the website, except in case of obvious error. If we detect a pricing error in any product you have ordered, we will inform you as soon as possible and give you the option of confirming your order at the correct price or cancelling it. If we are not able to contact you, your order will be cancelled and the full amount refunded.
We are not obligated to provide you with any product at a price lower than the correct price if the pricing error was obvious and unmistakable and if it could have been reasonably recognized by you as such.
Prices can be changed at any moment, but any possible alteration will not affect orders already placed and accepted.
6. Refusal to process an order
We reserve the right to remove any products from the website at any moment, or to modify any content therein. Despite always doing our best to process all orders, exceptional circumstances may arise wherein we are forced to refuse to process an order after the Order Confirmation email has been sent, and we reserve the right to do this at any moment. We will be liable for any removal or modification of any content from the website, nor for refusing to process an order once an Order Confirmation email has been sent. We also reserve the right to refuse personalized orders where the client’s requested message does not match with the philosophy and values of our company.
Payment can be made using the Portuguese ATM network (Rede de Caixas Multibanco) or through online banking, either with a Multibanco payment or by bank transfer. Once the relevant reference numbers have been provided, you have 72 hours to complete the transfer. If no such payment has taken place within 72 hours, your order will be automatically cancelled.
We use industry standard measures to ensure that payments are made securely.
Payments made by credit card through PayPal are subject to verification and authorization by credit card providers. If the relevant provider does not authorize payment, we are not responsible for any delay or failure in delivery and we are unable to formalize any Contract with you.
Any costs or fees related to customs, should they exist, are to be paid by the client.
8. Exchanges and returns
- Legal right to withdraw
In accordance with relevant laws, if you have entered into a contract with us, you may change your mind at any time within 30 days from the date you receive the Shipping Confirmation. To do so you must communicate your desire the terminate the contract and return the items within the period stipulated above.
- Right to change your mind
As well as the legal right to withdraw granted to consumers and outlined in the Clause above, we offer you a period of 30 days from the date you receive the Shipping Confirmation to return any items. Passeatta.com reserves the right to refuse returns that I. have been requested or sent outside this 30-day period, II. if the items show any signs of use, or III. if they are not delivered in the same condition in which they were sent. Items must be returned with the tag attached along with their original packaging.
If you live within the European Union, any costs associated with returns will be covered by us for your first return, and only for returns due to size or to defective items. Should you wish to make a second return, any associated costs will be covered by you. If you live outside the European Union, all shipping costs for exhanges and/or returns are your responsibility.
For us to be able to process any return or exchange based on any of the above clauses, it is strictly necessary that:
I – The items have not been used or laundered
II – The items maintain their orginal characteristics
III – The items are whole with all labels and tags intact
IV – The items have not been altered
For items personalized by the client, it is not possible to offer refunds or to accept exchanges for other products. We can only accept exchanges for other sizes.
- Return of defective items
You have the right to return products that present defects or otherwise do not conform to the items you ordered. In this case, the return must be made within 30 days from the date you received the Shipping Confirmation.
Any costs related to returns caused by defective or non-conforming items will be covered by passeatta.com.
- Unable to Deliver
If for any reason not attributable to us we are unable to deliver your items (such as incorrect address), and the order is return to us, we will make every effort to contact you to confirm your correct details. If we are unable to contact you we will assume you that you wish to cancel the contract and it will be terminated. As a result, any payments received from you will be returned, except delivery charges.
